Referral to committee

On 23 May 2017, the Hon. Anthony Lynham MP, Minister for State Development and Minister for Natural Resources and Mines, introduced the Land Access Ombudsman Bill 2017.

In accordance with Standing Order 131 of the Standing Rules and Orders of the Legislative Assembly, the Bill was referred to the Infrastructure, Planning and Natural Resources Committee (the committee) for detailed consideration. The committee was required to report by 7 August 2017.

The Bill

The purpose of the Bill is to:

  • establish an independent land access ombudsman with the jurisdiction to provide an independent service that applies to disputes relating to an alleged breach of a:
    1. conduct and compensation agreement between an owner or occupier or private land and a resource authority holder; and
    2. make good agreement between the owner of an impacted bore and a resource tenure holder
  • save transitional provision of the Mineral and Energy Resources (Common Provisions) Transitional Regulation 2016 that would otherwise expire in September 2017 and, as a consequence, amend associated provisions.
