Referral

On 22 August 2013 the Guide, Hearing and Assistance Dogs (Places of Accommodation) Amendment Bill 2013 was introduced into the Legislative Assembly by Mrs Desley Scott MP, Member for Woodridge.

The Bill was referred to the Health and Community Services Committee in accordance with Standing Order 131. The committee was required to report to the Parliament by 24 February 2014.

Objectives of the Bill

The object of this Bill is to amend the Guide, Hearing and Assistance Dogs Act 2009 to make it an offence for a person in control of accommodation offered to the public to deny accommodation to a person with a disability who relies on a certified guide, hearing or assistance dog.

Examination of the Bill

The role of the committee is to examine the policy to be given effect by the Bill and the application of fundamental legislative principles in section 4 of the Legislative Standards Act 1992.

Bill Discharged from the Committee

The Transport, Housing and Local Government Committee examined the Residential Tenancies and Rooming Accommodation and Other Legislation Amendment Bill 2013, which proposed amendments to the Guide, Hearing and Assistance Dogs Act 2009 about accommodation for people who rely on a guide, hearing or assistance dog. The Bill was debated and passed by the Legislative Assembly on 30 October 2013. 

On 31 October 2013, the Speaker of the Legislative Assembly ruled:

  • Standing Order 87 provides that a question or amendment shall not be proposed which is the same as any question which, during the same session, has been resolved in the affirmative or negative.
  • Therefore, in accordance with Standing Orders, the Guide, Hearing and Assistance Dogs (Places of Accommodation) Amendment Bill 2013 cannot proceed and is discharged from the Notice Paper. Its referral to the Health and Community Services Committee [the Committee] is also consequently discharged.

This Bill, therefore, will not be examined by the Committee.
