The petition of the electors of the division of Hervey Bay in the State of Queensland, draw tot h attention of the House material change of use (MCU-141070) submitted by Anscape Pty Ltd, to the Fraser Coast Regional Council (FCRC), for development of 500 independent living units (ILUs and other infrastructure on Lot 996 SP 129069. Land is adjacent to RAMSAR wetland located in the GSS Marine Park.

The claypan and mangrove  forest adjacent to this proposed development is classified as a Critical King Tide Roost for many species of migratory birds. More than 1% of the worldwide population of critically endangered Eastern Curlews utilise this site.

EPBC Referal 2013/7038 was submitted to the Commonwealth to develop 450 ILUs and other infrastructure in October 2013. DEHP Qld submitted reply, File/Ref CBD/111345 (Pt5) dated 6/11/2013.

Referral became a Controlled Action requiring submission by the developer of a Public Environment Report (PER). This is yet to be received. Relevant controlling provisions cover Wetlands of international importance, listed threatened species and communities and listed migratory species.

Your petitioners, therefore, request the House to:

1. Take note of and confirm to the petitioners that your Environment and Local Government Ministers are aware of

a) DEHP QLD reply dated 6/11/2013

b) EPBC Referral 2013/7038 and

c) FCRC MCU-141070

2. Take note of the non-conforming petition tabled 16/10/2013 containing 367 signatures and approximately 81% of the Turtle Cove residents against this development proceeding.
