Concurrent Inquiry - Sexually explicit outdoor advertising

The Health and Community Services Committee (HCSC) is currently inquiring into sexually explicit outdoor advertising.  The inquiry terms of reference require the HCSC to consider regulatory frameworks for outdoor advertising.   The regulatory framework proposed in the Classification of Publications (Billboard Advertising) and Other Legislation Amendment Bill 2013 is one of the regulatory options the HCSC may consider.

Submissions made to the Committee’s Bill inquiry on the Classification of Publications (Billboard Advertising) and Other Legislation Amendment Bill 2013 will be available to the HCSC once published by the Committee.

Objective of the Bill

The objective of the Bill is to amend the Classification of Computer Games and Images Act 1995, the Classification of Films Act 1991 and the Classification of Publications Act 1991 to regulate advertising on billboards through classification.

Reasons for the Bill

The reasons for the Bill is to regulate billboard advertising and mobile billboard advertising throughout Queensland and change the behaviour of the advertising and marketing industries use of moderate (Mature (M)) or strong (Mature Accompanied (MA15+)) content.

The Bill will also determine a framework for mandatory billboard geographical zoning based on classification ratings. This will reduce the risk of exposing communities to the displaying of moderate (Mature (M)) or strong (Mature Accompanied (MA15+)) content in areas highly frequented by families and children.

Report

On 25 November 2013, the Committee tabled its Report No. 47, Classification of Publications (Billboard Advertising) and Other Legislation Amendment Bill 2013. A copy of the report is available here or can be accessed at Related Publications.

As the Committee made a single recommendation for the Legislative Assembly to not pass the Bill, there is no requirement for the Government to table a response.

The Classification of Publications (Billboard Advertising) and Other Legislation Amendment Bill 2013 failed the second reading on 2 April 2014.

Referral

On 23 May 2013, the Member for Dalrymple introduced the Classification of Publications (Billboard Advertising) and Other Legislation Amendment Bill 2013 into the Queensland Parliament. 

In accordance with Standing Order 131 of the Standing Rules and Orders of the Legislative Assembly, the Bill was referred to the Legal Affairs and Community Safety Committee (the Committee) for detailed consideration.

Under Standing Order 136(1), the Committee must report to the Parliament on or before 25 November 2013.
