COMMITTEE’S REPORT
The committee tabled Report No. 26, 57th Parliament - Inquiry into the report on the strategic review of the functions of the Integrity Commissioner on 3 June 2022. The report can be accessed here.
ABOUT THE INQUIRY
Section 86 of the Integrity Act 2009 sets out a requirement for 5-yearly reviews of the Integrity Commissioner’s functions (‘strategic review’) to be undertaken by an independent reviewer to assess whether those functions are being performed economically, effectively and efficiently. The parliamentary committee with oversight responsibility for the Integrity Commissioner is required to be consulted on the terms of reference and appointment of the independent reviewer for the strategic review, and is also charged with considering the final report on the strategic review, which is required to be tabled in the Legislative Assembly by the responsible Minister (see sections 86 and 88-89 of the Integrity Act 2009).
On 11 March 2021, Mr Kevin Yearbury PSM was appointed to undertake the second 5-yearly review of the functions of the Integrity Commissioner, following consultation with the committee on his appointment and on the terms of reference for the review.
On 14 October 2021, the Premier and Minister for the Olympics tabled Mr Yearbury’s final review report. The report was automatically referred to the committee for its consideration under section 88(7) of the Integrity Act 2009.

The committee’s role is to examine the strategic report and ‘if appropriate, to comment on any aspect of the report and to make recommendations’ (section 89(d)). The committee also has a related, general responsibility to ‘report to the Legislative Assembly any changes to the functions and procedures of the integrity commissioner the committee considers desirable for the more effective operation of this Act’ (section 89(e)).
