Overview

On 28 November 2001, the Queensland Parliament referred the Electoral (Fraudulent Actions) Amendment Bill 2001, a private Member’s bill, to the Committee for consideration and to report back to the Parliament before 31 March 2002. The Bill sought to amend the Electoral Act 1992 (Qld) by inserting a new “catch-all” provision to make it an offence to fraudulently do any act with intent to influence the outcome of an election held pursuant to the Electoral Act 1992. The bill raised a number of issues including constitutional validity and mandatory minimum sentences.
