About the Bill

On 11 October 2011, The South-East Queensland Water (Distribution and Retail Restructuring) and Other Legislation Amendment Bill 2011 was introduced by the Minister for Energy and Water Utilities, Hon Stephen Robertson MP, and referred to the Environment, Agriculture, Resources and Energy Committee in accordance with Standing Order 131. The committee will now examine the policies to be enacted by the Bill and the application of fundamental legislative principles, as set out in s 4 of the Legislative Standards Act 1992. The committee will report to the Parliament by 5 April 2012.

The Bill amends the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009, the Energy and Water Ombudsman Act 2006, the Plumbing and Drainage Act 2002, the Queensland Competition Authority Act 1997, the Queensland Competition Authority Regulation 2007, the Water Act 2000 and the Water Supply (Safety and Reliability) Act 2008.

The objectives of the Bill are to:

  • Enable the withdrawal of a council water business from its South East Queensland (SEQ) distributor-retailer and re-establishment of the water business within direct council operations;
  • Apply certain requirements of the South-East Queensland Water (Distribution and Retail Restructuring) Act 2009 (DR Act) to these specific council water businesses;
  • Apply additional requirements to the continuing SEQ distributor-retailers to provide greater clarity for councils’ pricing and decision-making role with respect to their distributor-retailers;
  • Provide that the Queensland Competition Authority (QCA) will have a price monitoring/oversight role of the new council water businesses; and
  • Make minor consequential changes
