Toowoomba Regional Council’s decision not to defend a full Council’s unanimous vote against development of a 24 hour 7/11 service station within a very low park residential location (MCUI/2016/1775 and OWS/2016/1778)

Queensland residents draws to the attention of House the conduct of the Toowoomba Regional Council relating to above mentioned application. Specifically, at a full public council meeting the Mayor and all Councillors unanimously voted against this application. Despite Council's decision, it decided not to defend their resolution at the Planning and Environment Court when the developer appealed. Therefore the Judge was not presented with objections or concerns of the community.

 

The main concern of petitioners is that this area is not serviced by a reticulated sewerage system. Now a 24 hour 7 day a week service station - hard against park residential housing - has been approved to operate on septic. Another concern was that Council had completed years of community engagement regarding this location and was in the process of changing the zoning to restrict such development. This application was submitted just before such changes were made binding – this was totally ignored; which according to Coty Principal, should have had significant weight.

 

Your petitioners therefore request the House to call in this application and place a stay on construction work immediately and reconsider this development.
