The Petition of residents of the State of Queensland draws to the attention of the House the urgent need for greater public awareness of the powers of the Queensland Public Trustee and Public Guardian in cases of incapacity and aged care. Many Queenslanders are unaware that, if a person lacks capacity to make decisions (as assessed by doctors or QCAT), the Public Guardian - when appointed - can make personal decisions including placement in a nursing home if no family or affordable 24/7 support is available. Additionally, the Public Trustee - when appointed as administrator - can sell the family home, or other assets to cover nursing home fees, even against the wishes of owners or families, potentially leaving adult children homeless and with minimal inheritance. This lack of transparency causes them stress and unpreparedness during vulnerable times.
Your petitioners, therefore, request the House to mandate the Queensland Public Trustee and Public Guardian to advertise these powers widely to Queenslanders and Australians through television, social media, and all feasible channels; and to ensure campaigns are clear, accessible, and include guidance on preventative measures, like enduring powers of attorney.
