The Petition of residents of the State of Queensland draws to the attention of the House that Queensland currently has no legislation that specifically protects residents of standalone homes from tobacco smoke or vaping aerosol drifting from neighbouring properties. Many Queenslanders who choose not to smoke or vape are nonetheless exposed to second-hand smoke and vapour within their own homes due to continual drift from nearby residences. This exposure places children, people with chronic illness, and others at increased health risk, and can cause significant discomfort and respiratory irritation. Persistent smoke or vapour drift can fill living spaces, limit families’ ability to enjoy their homes and outdoor areas, and undermine their right to a safe and healthy environment. Existing laws do not provide a clear or effective pathway for residents to seek assistance when their wellbeing and daily living are repeatedly impacted.
Your petitioners, therefore, request the House to do all within its power to:
- Develop legislation that creates enforceable obligations preventing smoke and vaping aerosol from drifting onto neighbouring private properties.
- Establish offences or penalties for repeated or unreasonable emissions that expose others to health risks within their own homes.
- Provide clear and accessible mechanisms for reporting, investigation, and resolution when residents are continually affected by smoke or vapour drift.
- Promote public health measures supporting smoke-free and vape-free practices where emissions may impact neighbouring households.
