Queensland residents draws to the attention of the House:

1. Dataset from QoVax (Queensland COVID-19 Vaccination Safety and Efficacy Trial) program is of major national/international significance.

2. The $20 million (now defunded) QoVax program was set up to examine the safety and efficacy of COVID-19 impacts, boasted 10,000 adult Queenslanders, covering 86% of Queensland post codes, generating over 100,000 biospecimens, and gathering over 11 million data points.

3. Destruction of this dataset and bio-specimens is arguably unlawful under:

a. s129 of the Criminal Code Act 1899 making it an offence to destroy evidence or ‘potential’ evidence relevant to judicial proceedings; and

b. Public Records Act 2002 (specifically the Health Sector (Clinical Records) Retention and Disposal Schedule), which stipulates records from clinical research involving adult patients must be retained for 15 years from the completion, publication or termination of the study.

4. Multiple national and international studies are underway, many with adverse findings confirming integration and persistence of synthetic DNA and spike protein in COVID-19 vaccinated individuals.

5. QoVax dataset is of immense scientific importance for its potential contribution to these studies and ongoing and subsequent legal proceedings.

6. There is concern that failure to preserve this material would amount to potential tampering with evidence placing all record custodians, data managers from Queensland Health and any agencies involved in the QoVax program at reputational and legal risk.

Your petitioners, therefore, request the House to provide the reasons why the dataset and biospecimens from the QoVax program are not being lawfully retained.
