Queensland residents draws to the attention of the House residents of a gated community on the Sunshine Coast wish to advise that in the purchase of their homes they have been deliberately misled as to the proposed number of homes in the village. At the point of sale, residents, with few exceptions, were advised by sales staff that they were purchasing a home in a Village of a total of 190 homes. All sales material distributed was designed to show a total of 190 homes. The developer continues to advertise the village as a total of 190 homes. In August 2020 residents became aware that the developer had applied to Sunshine Coast Council to commence earthworks to the village for 300 homes. Further research showed that Council had approved 297 proposed home sites for development since 2014. Current residents have been deviously misled into purchasing properties, the values of which have been severely compromised by the proposed extension, as has their future peace and lifestyle. The developer has used wording of the Manufactured Homes (Residential Parks) Act 2003 to withhold the required Initial Disclosure documents, in particular Real Property Description, from buyers until most had committed to selling previous homes.

Your petitioners, therefore, request the House to amend the Manufactured Homes (Residential Parks) Act 2003 to require disclosure of planning and development information and intent at the initial point of sale, (as per the Retirement Villages Act 1999 Part 5). This will provide development information at the earliest possible stage.
